1. INTRODUCTION AND ACCEPTANCE

1.1  These Terms and Conditions govern your use of the Thermal Earth Ltd website (www.thermalearth.co.uk) and any purchases, bookings, or transactions made through the website.

1.2  By accessing or using this website, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use this website or make any purchases.

1.3  Thermal Earth Ltd is a company registered in England and Wales (Company Number: 06225060) with its registered office at Capel Hendre Industrial Estate, Ammanford, Carmarthenshire, Wales.

1.4  We reserve the right to amend these Terms and Conditions at any time. Your continued use of the website following any changes constitutes acceptance of those changes.

2. DEFINITIONS

In these Terms and Conditions:

2.1  "Company", "We", "Us", or "Our" means Thermal Earth Ltd.

2.2  "Customer", "You", or "Your" means the person or entity purchasing services or products through our website.

2.3  "Services" means ground source heat pump installation, design, consultation, maintenance, and heat supply subscription services.

2.4  "Products" means heat pump equipment, components, and related goods sold through the website.

2.5  "Website" means www.thermalearth.co.uk and any related subdomains.

2.6  "Contract" means the legally binding agreement formed when we accept your order or booking.

3. WEBSITE USE AND ACCOUNT REGISTRATION

3.1  You must be at least 18 years of age to make purchases through this website. By placing an order, you confirm that you meet this requirement.

3.2  If you create an account on our website, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.3  You must provide accurate, current, and complete information during registration and when placing orders. You agree to update your information promptly if it changes.

3.4  You must not use the website for any unlawful purpose or in any way that could damage, disable, or impair the website.

3.5  We reserve the right to suspend or terminate your account if you breach these Terms and Conditions.

4. ORDERS, QUOTATIONS, AND BOOKINGS

4.1  All orders placed through the website are subject to acceptance by Thermal Earth Ltd. We reserve the right to refuse any order at our discretion.

4.2  Your order constitutes an offer to purchase services or products. A contract is only formed when we send you an order confirmation email accepting your order.

4.3  Quotations requested through the website are estimates only and remain valid for 30 days from the date of issue unless otherwise stated. Final pricing will be confirmed in writing before work commences.

4.4  Consultation bookings and site surveys requested through the website are subject to availability. We will confirm your appointment date and time by email.

4.5  All prices displayed on the website are in Pounds Sterling (GBP) and include VAT at the prevailing rate unless otherwise stated.

5. PAYMENT TERMS

5.1  Payment for products, deposits, and consultation fees can be made through the website using our secure payment gateway (credit card, debit card, or other methods as displayed).

5.2  For installation services, a deposit payment may be required at the time of booking. The deposit amount will be clearly stated and is non-refundable except as set out in Section 6.

5.3  Full payment terms for installation projects will be set out in a separate written contract. Typically, payments are structured in stages aligned with project milestones.

5.4  For subscription-based heat supply agreements, payment terms and direct debit arrangements will be detailed in your separate Heat Supply Agreement.

5.5  We use industry-standard encryption to protect your payment information. We do not store complete credit or debit card details on our servers.

5.6  If payment is declined or fails, we reserve the right to cancel your order or suspend services until payment is received.

6. CANCELLATION AND REFUND POLICY

6.1 Consumer Rights

6.1  If you are a consumer, you have the right to cancel most contracts made online within 14 days of placing your order without giving any reason (Consumer Contracts Regulations 2013).

6.2  To exercise your right to cancel, you must inform us of your decision in writing by email to info@thermalearth.co.uk or by post to our registered address.

6.2 Consultation and Survey Bookings

6.3  Consultation and site survey bookings can be cancelled free of charge up to 48 hours before the scheduled appointment.

6.4  Cancellations made less than 48 hours before the appointment may incur a cancellation fee of up to 50% of the consultation fee.

6.5  If you have requested that services begin within the 14-day cancellation period and then wish to cancel, you must pay for the services provided up to the point of cancellation.

6.3 Installation Project Deposits

6.6  Installation project deposits paid through the website are non-refundable once design work has commenced, except in cases where we are unable to proceed with the project.

6.7  If we are unable to proceed with your installation project for reasons within our control, we will provide a full refund of any deposit paid.

6.4 Product Purchases

6.8  Products purchased through the website may be returned within 14 days of receipt, provided they are unused, in original packaging, and in resalable condition.

6.9  Return shipping costs are the responsibility of the customer unless the product is faulty or incorrect.

7. DELIVERY AND PERFORMANCE OF SERVICES

7.1  Delivery dates and service completion dates provided on the website or in confirmations are estimates only and are not guaranteed.

7.2  Products will be delivered to the address specified in your order. You must ensure someone is available to receive delivery.

7.3  Installation services will be performed at the property address specified in your order, subject to site survey confirmation of suitability.

7.4  We will make reasonable efforts to complete services within estimated timeframes, but we are not liable for delays caused by circumstances beyond our reasonable control.

7.5  Risk in products passes to you upon delivery. Title passes to you upon receipt of full payment.

8. PRODUCT INFORMATION AND WEBSITE ACCURACY

8.1  We make every effort to ensure that product descriptions, specifications, and pricing on the website are accurate. However, errors may occur.

8.2  If we discover an error in pricing or product information after you have placed an order, we will contact you to inform you of the error and give you the option to proceed at the correct price or cancel your order.

8.3  Product images are for illustrative purposes only. Actual products may vary slightly in appearance.

8.4  Technical specifications and performance estimates are based on standard conditions and may vary depending on site-specific factors.

9. INTELLECTUAL PROPERTY RIGHTS

9.1  All content on this website, including text, graphics, logos, images, software, and design, is the property of Thermal Earth Ltd or our licensors and is protected by UK and international intellectual property laws.

9.2  You may view, download, and print content from the website for your personal, non-commercial use only.

12. WARRANTIES AND GUARANTEES

13.2               Such circumstances include but are not limited to acts of God, severe weather, flood, fire, war, civil disturbance, terrorism, industrial disputes, government restrictions, and failure of suppliers or subcontractors.

13.3               In such circumstances, we will notify you as soon as reasonably practicable and will use reasonable efforts to minimize the impact of the delay.

14.1               The website may contain links to third-party websites or services that are not owned or controlled by Thermal Earth Ltd.
